Equity Actions: Determining Ownership Recovery of Assets

Most probate and fiduciary litigation, as well as inter-family legal disputes, concern trying to determine what parties are entitled to what assets.  Personal representatives, trustees or family members who find themselves the joint owners of real estate are often embroiled in litigation to recover or determine ownership or equitable interests.

The program will provide an overview of how a lawyer can use the following claims to recover assets including:

  • Complaints for instructions and for declaratory judgments
  • Breach of fiduciary duty
  • Unjust enrichment
  • Rescissions of deeds, gifts and trusts
  • Fraud
  • Conversion
  • Breach of contract
  • Interference with inheritance
  • Interference with advantageous/contractual relationship

The program will also explore factors involved in considering whether to file claims in the Probate and Family Court or the Superior Court, as well as when and how to seek consolidation.  The panel will address the interplay between pending probate and related equity matters; issues to keep in mind when settling disputes; and potential procedural pitfalls when there are multiple beneficiaries, including minors.
