Divorce and the Marital Home in the Age of COVID-19

The strains of the coronavirus pandemic have sparked an increase in marital dissolution applications. This program addresses various issues concerning the marital home in divorce proceedings from the perspective of family law, taxation and real estate attorneys.

Panelists will discuss the interspousal transfer of ownership of the marital residence and its attendant issues, including first-refusal rights, second mortgages, deferred distribution, refinancing and the impact of the parties' credit. The tax aspects of such scenarios, including the shielding of spouses from the capital gains tax implications in the equitable distribution of the property, will be addressed, as well.

This program will also look at how to handle the income stream generated by couples whose second home is a rental property. The panel will also provide tips on drafting separation agreement provisions and discuss potential pitfalls in finding mutually agreed-upon real estate brokers and appraisers.
