In April during the COVID-19 pandemic, Massachusetts enacted an eviction moratorium that is due to end on Oct. 17. During the moratorium, landlords are barred from sending notices to quit and filing summary process nonpayment complaints with the Housing Court. When the moratorium ends, courts are expected to see a flood of new case filings. This is a two-part series designed to help landlord and tenant attorneys represent their clients effectively during this unprecedented situation.
This program will outline how to negotiate an agreement for judgment in Housing Court for summary process nonpayment cases. Attorneys for landlords and tenants can often obtain a satisfactory outcome for their clients without proceeding to trial. Many nonpayment cases conclude in an agreement for judgment, which can include either an agreement to vacate or a repayment plan. Our panel of experts will discuss the key components and potential pitfalls of a negotiation, as well as how to prepare your client for the process.
