Upcoming CLE on Nov. 17: The Proposed CMS Rule Banning Pre-Dispute Arbitration Agreements in the Long Term Care Context and Attendant Litigation

On September 29, 2016, the Center for Medicare and Medicaid Services issued a final rule prohibiting the use of pre-dispute arbitration agreements in resident agreements with long term care facilities. A lawsuit challenging the agency's authority to do this was promptly filed in the United States District Court for the Northern District of Mississippi on October 18, 2016, and, on November 7, 2016, the Court issued a preliminary injunction delaying the rule from taking effect until its legality could be definitively determined by the Courts. This brown bag lunch will provide a timely update and analysis of these important events, and also discuss, as background, similar regulatory action taken by the Consumer Finance Protection Bureau with respect to the use of pre-dispute arbitration provisions in consumer finance agreements containing class action waivers.
