Unconscious Bias: What Can We Do About
It?
Unconscious bias is a concern for mediators and arbitrators because we have
an ethical duty to be impartial. David A. Hoffman, Founder, Boston Law
Collaborative, LLC and Lecturer on Law, Harvard Law School will facilitate a
discussion of this topic, which he will introduce with a 10-15 minute
presentation about what the fields of social and cognitive psychology have
learned about where bias comes from, how it can be measured, and what we can do
about it.
Being a practitioner in the field of dispute resolution (DR) can for many of
us be a lonely profession. How often have you wanted to learn how your peers
would have handled situations that have arisen during one of your mediations,
conciliations, collaborative processes or arbitrations? Each of us has very
differing styles. How can we improve our skills by learning from others?
