Navigating the MBTA Communities Act

Please join the Massachusetts Bar Association’s Real Estate Law Section’s Construction Law Practice Group for this important program on navigating the MBTA Communities Act. This in-person program will include a timely discussion of the implementation of important legislation.

This discussion will bring together developers, policymakers, legal experts, builders and community stakeholders to discuss the law’s early outcomes (e.g., the pipeline of nearly 8,000 new units across approximately 40 communities as of early 2026). It will also examine the ongoing challenges of compliance enforcement and modest transit-oriented gains, and forward-looking strategies such as integrating affordable housing incentives, commercial conversions and climate-resilient building practices. The statute aligns with the state’s push for more housing amid stable market conditions.

This program is especially timely given the upcoming case addressing rent control headed to the Supreme Judicial Court.
