Join us for the Massachusetts Bar Association’s Taxation Law Section Council’s Tax Talk Tuesdays luncheon series, where tax law attorneys gather to discuss the latest trends, developments and insights in the world of taxation. This series will feature multiple in-depth programs designed to provide valuable updates and expert perspectives on key topics shaping the tax landscape.

This Tax Talk Tuesdays program will discuss the financing of affordable residential rental housing with tax-exempt bonds (“TE MF Housing Bonds”).

Topics will include:

  • The types of governmental issuers that typically issue TE MF Housing Bonds; 
  • Required set-asides for low-income tenants that a project financed in whole or in part with TE MF Housing Bonds must provide; 
  • What constitutes qualified residential rental housing; 
  • What non-housing-related rules must be met for these deals to qualify for tax-exempt bond status (such as limitations on the earnings on investment of bond proceeds pending expenditure, rebate of arbitrage profits to the federal government, limitation on bond maturity, limitation on use of bond proceeds for certain facilities, information return requirements and other requirements); 
  • Typical structures of TE MF Housing Bond transactions (public offering, direct bank purchase, line of credit draw); and
  • The relationship between TE MF Housing Bonds and the low-income housing tax credit (including areas of overlap and difference).
