How to Succeed in Adjudicatory Proceedings and Administrative Appeals

Administrative tribunals play a significant role in almost every aspect of legal practice in the public sector, as evidenced by the scores of decisions rendered weekly by administrative tribunals throughout the commonwealth.  While each administrative agency may have rules or practices that are particular to that agency, there are common considerations that apply to all administrative proceedings, and can make the difference between success and failure in your practice before state administrative tribunals.  This program will review those common considerations, as well as challenging issues that confront administrative law practitioners.

Intended for attorneys who have at least some experience with administrative law procedures and practice, this program will include discussion of the following topics:

  • An update from the Division of Administrative Law Appeals (DALA)
  • Thorny evidentiary and other issues that arise when presenting a case before an administrative tribunal
  • The top reasons why agency decisions get overturned on appeal
  • What administrative law judges look for when hearing cases
  • View from the bench – a  judicial perspective on court appeals of administrative agency decisions
