Special Federal Torts Claim Act Training on Claims Against ICE & DHS

Many of you have watched the events in Minneapolis/St. Paul, and in other cities throughout our country and thought, what can I do? Is there a way I can use my legal skills to help hold ICE and DHS legally accountable? Actually, yes you can!

Please join us for a timely webinar about how to assess and effectively pursue Federal Tort Claim Act (FTCA) damage cases to promote DHS/ICE accountability, while providing victims of their unlawful enforcement actions compensation for the harm they have endured. Our webinar is part of an important new statewide initiative, focused on training and recruiting Massachusetts police misconduct, civil rights, and tort litigators, and federal court practitioners, to receive FTCA case referrals as part of our coordinated federal court FTCA litigation project.

A claim under the FTCA allows for recovery of money damages from the United States for abuse and misconduct by employees of federal agencies, including by ICE and DHS agents, for assault and battery, false imprisonment, abuse of process, malicious prosecution, destruction of property and similar state tort claims. The FTCA authorizes attorney fees of 20% of the recovery for administrative settlements and 25% from a trial   or a settlement after filing.

Our webinar will address the filing of an initial administrative claim under the FTCA, including what to prepare, where and how to submit the claim, and what to expect after submission. We will also discuss requirements related to the filing of FTCA claims in federal court, litigation strategies, techniques, and challenges, and other legal claims that may be joined.

At some point in April or May, interested attorneys will be invited to complete and submit an “Application Form” to join a panel of attorneys to receive FTCA case referrals. Once accepted to the panel, members of the panel will receive additional training and access to mentors.

We are excited that Attorney David Rudovsky, a nationally recognized expert on FTCA claims, will serve as the lead presenter for our webinar. Attorney Rudovksy is the author of one of the most relied upon publications on police misconduct litigation, including through the FTCA. He is founder of Kairys, Rudovsky, Messing & Feinberg, LLP. He has practiced in the civil rights and criminal defense fields for over forty years.
